Nelson Tasman Regional Landfill Business Unit – Delegations

 

The Nelson Tasman Regional Landfill Business Unit (NTRLBU) is a joint committee of Nelson City and Tasman District Councils.  The NTRLBU is governed by a Terms of Reference (A1983272).

Areas of Responsibility

·            Matters relating to the operation and use of the York Valley and Eves Valley landfills as regional landfill facilities, and the timing of their use.

Powers to Decide

·            Setting of fees and charges for waste disposal at the regional landfill facilities by 30 June each year; including the power to apply discounted fees and charges for the disposal of waste in bulk; and to determine other circumstances where discounted fees and charges may be applied.

·             Decisions to accept (or not accept) waste that is generated outside the Nelson-Tasman region.

Power to Recommend to Councils:

·            Any other matters under the area of responsibility of the Business Unit

 

·            All recommendations to Council will be subject to adoption of an equivalent resolution by the other Council, unless it is a matter specific to one Council only.

Quorum:

·            The Memorandum of Understanding governing the NTRLBU allows for either four or five members to be appointed.  The quorum at a meeting is either two (if four members are appointed), or three (if five members are appointed), including at least one from each local authority.

Procedure:

·                The Standing Orders of the Council providing administration to the committee shall be applied at each meeting

 

·                The Chairperson will not have a casting vote

The Chairperson gave a verbal report, noting her appreciation of the work the Regional Landfill team had been doing, including work on the Draft Activity Management Plan (AMP), Draft Business Plan, and Quarterly and Yearly Reports.

She noted the shift in focus and key tension points and acknowledged that the team was following the Committee’s direction and providing good advice going forward.

7.       Nelson Tasman Regional Landfill Business Unit - 2021/22 Business Plan and 2021 - 2031 Activity Management Plan.

Document number R20294, agenda pages 10 - 139 refer.

General Manager Regional Sewerage and Landfill, Nathan Clarke, presented the report and summarised the key issues. It was noted that the Draft AMP would be presented to both Councils for feedback and agreed that the Chairperson and Mr Clarke would speak to the recommendations to both Councils when the matter was considered at the respective meetings.

Discussion included the implementation of a fire detection system, the Emissions Trading Scheme, landfill life, budget contingency and waste projections, gas extraction, funding opportunities for weighbridges and the consultation process and timeframe.

A suggestion was made that it might be more efficient for the Business Unit to consult on the AMP directly and not via the LTP and clarification be sought on the legislation regarding this.

The possibility of working on the AMP one year in advance was discussed, and it was indicated that this would streamline and remove a pressure from the AMP preparation for both the Councils and the NTRLBU officers, this was deemed to be a good idea.

A request was made to make it clear what had driven the increases in landfill charges.

It was highlighted that all long term objectives and key performance measures discussed at the earlier workshop needed to be SMART.

The need for minor amendments to the graphs was noted.

In order to allow the Committee time to discuss the feedback from both Councils, it was agreed to add ‘by 30 November 2020’ to clause 1 of the recommendation to the Councils.

8.       Nelson Tasman Regional Landfill Business Unit Quarterly Report and 2019/20 Annual Report

Document number R20277, agenda pages 140 - 176 refer.

General Manager Regional Sewerage and Landfill, Nathan Clarke, presented the report. He updated the Committee on the stormwater breach of consent and the fire on the landfill, which had identified that better training and increased cognisance of risk was required.

It was noted that the operator that had suffered a heart attack was back on light duties. This led to a discussion on defibrillators and it was confirmed that all site workers had undertaken CPR training. In response to a question from the Group Manager Infrastructure, Mr Clarke advised that the incident had not yet been logged in Nelson City Council’s Health and Safety system, InControl, but that Nelson City Council’s Health and Safety Advisor, Malcolm Hughes, was aware of the incident.

A request was made that the Solid Waste Analysis Profile (SWAP) be reported back to the next meeting.

       There were questions and discussion on the Annual Report. Accountant, Andrew Bishop, summarised points in the financial reporting. The Group Manager Infrastructure noted that the capital programme needed to be achievable and getting extra staff was not necessarily the best way forward, but the effect of the COVID-19 lockdown and stress levels needed to be considered to reduce the capital spend. Mr Clarke was asked to provide a review of the best way to deliver projects.

       In the matter of the capital work programme, it was noted that, with respect to TDC, that the quantum could not breach its debt cap.

       The rationale for the Eves Valley recommendation was explained.

1.       Purpose of Report

1.1      To consider feedback provided from Tasman District Council (TDC) and Nelson City Council (NCC) regarding the Nelson Tasman Regional Landfill Business Unit (NTRLBU) Activity Management Plan 2021 – 2031 (AMP) and the Nelson Tasman Regional Landfill Business Unit (NTRLBU) 2021/22 Business Plan (Business Plan).

1.2      To approve the NTRLBU AMP (A2511191) and NTRLBU Business Plan (A2495934) for submission to both Councils for inclusion in their Long Term Plans.

2.       Summary

2.1      NTRLBU has approved the Draft NTRLBU AMP and 2021/22 Business Plan and has submitted these to the NCC and TDC for consideration and feedback.

2.2      NCC and TDC have both considered the report and have provided feedback.

2.3      This report summarises the feedback and recommends a response from NTRLBU.

 

 

3.       Recommendation

4.       Background

4.1      The NTRLBU was established by NCC and TDC to manage and operate regional landfill facilities and the Terms of Reference require the NTRLBU AMP to be submitted to the two Councils for comment and then approval.

4.2      The NTRLBU resolved on 11 September 2020 as follows:

Approves the Draft Nelson Tasman Regional Landfill Activity Management Plan 2021-2031 (A2458268) for presentation to the Nelson City Council and Tasman District Council with delegation of all minor amendments to the Nelson Tasman Regional Landfill Business Unit Chairperson”.

Recommendation to Nelson City Council and Tasman District Council

That the Nelson City Council and Tasman District Councils:

Receive the Draft Nelson Tasman Regional Landfill Business Unit Activity Management Plan 2021-2031 (A2458268) for review, and provide feedback to the Nelson Tasman Regional Landfill Business Unit if required.

4.3      The NTRLBU can only formally adopt the Draft AMP after receiving and considering comments from the two Councils and is then required to present the final AMP to the Councils by 20 March, for inclusion in each Council’s draft Long Term Plan.

4.4      TDC approved the AMP subject to changes resulting from the TDC LTP process.

4.5      Discussion with TDC officers identified that the only voluntary project is the Eves Valley Landfill gas capture and destruction project. 

4.6      TDC feedback from TDC officers indicates that TDC would like NTRLBU to seek external funding for the project.

4.7      NCC gave formal feedback that the NCC believes that the landfill fees and charges are high, and are higher than expected, but that the works, and consequently the cost increases, were considered necessary.

5.       Discussion

           Feedback from TDC

5.1      The feedback received from TDC at the officer level was detailed and provided good context to the decisions being made.

5.2      These discussions recommended that external funding be sourced for the Eves Valley Landfill gas capture and destruction project.

5.3      The resolution approved by the TDC Strategy and Policy Committee in relation to the NTRLBU Business Plan and Activity Management Plan is as follows:

 

1.    notes that the Nelson Tasman Regional Landfill Business Unit Draft Business Plan 2021/2022 and the Draft Activity Management Plan 2021-2031 are included in the development of Council’s Long Term Plan 2021-2031, and

4.    notes that once Council’s Long Term Plan 2021-2031 has been adopted that the Nelson Regional Sewerage Business Unit and the Nelson Tasman Regional Landfill Business Unit will be notified of any changes made to the respective Draft Business Plans 2021/2022 and Draft Activity Management Plans 2021-2031.

5.4      The resolution from TDC is confusing as it seems to give no certainty that the programme proposed is accepted by TDC, and gives NTRLBU no confidence that the programme of works will not change during the LTP process. In accordance with the terms of reference LTP information is to be provided in sufficient time to enable the councils to carry out and complete their statutory planning and reporting. The reason that the plans were submitted for feedback was so that each council could give guidance to NTRLBU regarding any changes that they felt were required.

5.5      Following the TDC Strategy and Policy Committee meeting the NTRLBU Chair and GM had discussions seeking clarification from TDC staff on what the implications of this resolution were.

5.6      The GM understands from these discussions that TDC approved in principle the NTRLBU AMP subject to the changes previously discussed between TDC staff and NTRLBU GM, and that no changes would be required from NTRLBU.

           Feedback from NCC

5.7      NRSBU received formal feedback from NCC. No specific discussion regarding individual projects was undertaken. The feedback provided by NCC is shown below;

 

           Consideration of Feedback

5.8      The GM has spent considerable time reviewing the projects proposed in the NTRLBU Business and Activity Management Plans.

5.9      It is clear that NTRLBU owners are facing financial constraints and that any activities that can be deferred would assist the two Councils with their financial situations.

5.10    TDC officers have requested that NTRLBU seeks external funding support for the Eves Valley Landfill gas capture and destruction project.  NTRLBU propose to continue with the application for the Paris Accord Agreement application to accommodate this request.

Capital Expenditure Deferrals.

5.10.1  An option for capital expenditure deferral was considered that included deferring the development of the Eves Valley site for diversion activities and Eves Valley Gas capture and destruction activities.  This option included the deferral of around ~$1 Million of capital expenditure for one year.

5.10.2  The consequence of the capital deferrals would have resulted in a further year of carbon emissions from the Eves Valley Landfills and would have delayed the ability to divert clean materials for disposal at Eves Valley Landfill for another year. This would have resulted in reduced operational savings made from the clean material diversion, and the reduced ETS cost for the diverted material (~$150,000).

5.10.3  It would also have resulted in an increase in the cost of the weighbridge for the Eves Valley landfill by up to $100,000. This is due to the current plan being based on the assumption that NTRLBU can purchase the refurbished Ravensdown Ltd weighbridge rather than a new weighbridge. It is unlikely that this weighbridge will be available in the future if the project was deferred by an additional 12 months.

5.10.4  Following careful consideration regarding the disadvantages and the consequential costs, and when considered in light of the feedback received from NCC and TDC, this option for capital expenditure deferral is not considered appropriate.

6.       Conclusion

6.1      Both NCC (via formal council resolution) and TDC (via officers) provided feedback to NTRLBU, with only TDC requesting a change to the AMP and Business Plan.

6.2      The requested change was that NTRLBU seeks external funding for the Eves Valley Landfill gas capture and destruction project.

6.3      The feedback did not request deferrals of capital expenditure, and considered the projects necessary, albeit higher in cost than expected.

6.4      It is recommended that NTRLBU reconfirms adoption of the previously approved draft Business Plan and AMP 2021 - 2031 with minor corrections to account for updated information gained since the NTRLBU approved the AMP.

6.5      The primary reason for this recommendation is that the deferral of the capital expenditure will result in a number of consequential costs and difficulties and is therefore not considered appropriate.

7.       Next Steps

7.1      It is recommended that the NTRLBU Business Plan 2021/22 (A2495934) and NTRLBU Activity Management Plan 2021- 2031 (A2511191) are submitted to NCC and TDC for adoption and inclusion in their LTPs.

Important considerations for decision making

1.   Fit with Purpose of Local Government

The NTRLBU is a joint committee constituted pursuant to the provisions of Schedule 7 to the Local Government Act 2002. A regional landfill contributes to the four Local Government well-beings of social, economic, environmental and cultural.

2.   Consistency with Community Outcomes and Council Policy

The NTRLBU Disposal Fees feed into Council’s 2021-31 LTP and the NTRLBU Activity Management Plan feeds into the NCC and TDC Activity Management Plans.

3.   Risk

This report allows the community to comment on the NTRLBU fees and development through NCC community consultation processes.  These comments will be considered by the Board. The risk of not approving the fees is that this could delay the NRSBU implementing their Business Plan for 2021/22, could also delay the development of the Activity Management Plan, and could have a consequential effect on NCC and TDC Council Annual Plans and Activity Management Plans

4.   Financial impact

The NTRLBU 2021/22 fee reflects an increase in essential renewals expenditure and the commencement of the landfill including storm water upgrades.

5.   Degree of significance and level of engagement

The NTRLBU plans are included in the Long-term Plans and Annual Plans of each Council.  Consultation is undertaken by both Councils in the preparation and adoption of these plans.

6.   Climate Impact

A key feature of the NTRLBU Business Plan and Activity Management Plan are project that work toward mitigation of greenhouse gas emissions. This includes a commitment to measure and reduce greenhouse gas emissions from the facility

7.   Inclusion of Māori in the decision making process

No engagement with iwi has been undertaken in preparing this report, but iwi have representation on the Board.

 

8.   Delegations

       The NTRLBU may without the need to seek any further authority from the councils:

·     Set fees and charges for waste disposal at the regional landfill facilities by 30 June each year; including the power to apply discounted fees and charges for the disposal of waste in bulk; and may determine other circumstances where discounted fees and charges may be applied. For clarity, the fees and charges shall be included in the draft annual Business Plan that is submitted for Council approval each year.

Nelson Tasman Regional Landfill Business Unit Quarterly Report

     

 

1.       Purpose of Report

1.1      This report is a three monthly update by the General Manager (GM) on activities undertaken over the last three months by the Nelson Tasman Regional Landfill Business Unit (NTRLBU)

 

 

2.       Recommendation

 

That the Nelson Tasman Regional Landfill Business Unit

1.    Receives the report Nelson Tasman Regional Landfill Business Unit Quarterly Report (R21487) and its attachment (A2532146).

 

 

3.       Summary

3.1      Operations are generally running well, with the exception of stormwater management and the availability of the primary waste compactor.

3.2      It is becoming apparent that improvements are required with Health and Safety (H&S) and Environmental Management on the York Valley site following issues that have occurred over the last two Quarters.

3.3      The H&S issues leading to this include the poorly managed fire included in the last quarterly report and an operational staff member being injured this period, which resulted in him needing a medical assessment

3.4      Waste volumes are at pre COVID 19 levels and financial performance is better than budget with a profit for the period of $258,000 excluding gains related to Provincial Growth Funding.

4.       Background

4.1      This report is the GM update for three months to 30 September 2020.  It outlines the activities, issues and opportunities that have occurred during the last three months.

5.       Health and Safety

5.1      NTRLBU staff are concerned that the number of incidents that have occurred over the last six months, may be an indication of issues with its H&S system.

5.2      Over the last quarter period there was one notable incident, and a number of small fires caused by lithium ion batteries.

5.3      The notable incident was a Downer staff member at the landfill being struck by a falling board.

5.4      This incident occurred when the staff member was opening the door on the back of a waste transport container and a loose board fell from the truck striking the staff member.

5.5      The staff member was checked medically at the time and discharged, however after 10 days the injury had not healed effectively and the staff member was instructed to get further medical review.  The staff member has now recovered.

5.6      NTRLBU has requested the site investigations records for the incident, and the Safe Work Method Statement for the activity and are investigating further.

5.7      NTRLBU has also requested assistance from NCC H&S staff to audit H&S on the site, and confirm that there are no significant H&S issues.

5.8      The second aspect of concern is the frequency of small fires at the landfill being caused by lithium ion batteries.

5.9      Fires are becoming sufficiently frequent that NTRLBU now proposes (after discussion with NCC H&S personnel) to only report incidents when there is a fire that is not handled in the appropriate manner.

5.10    NTRLBU is installing thermal imaging cameras to allow early identification of fires afterhours, and a pressurised water supply so that fires can be managed effectively in the event the standard approach is not effective for some reason.


 

 

           NTRLBU Activities

6.1      It has been a very busy period for the NTRLBU staff, and there have been a number of issues and projects that have needed to be managed in addition to the normal operations.

6.2      Additional actions have been ongoing in regard to:

·             The waste compactor failed again and was out of service for two weeks. It is very fortunate that Downer has access to the old compactor, as the failure frequency occurring with the new Caterpillar compactor is unacceptably high. Downer has begun looking at alterations to the compactor wheels to reduce the stress the compactor is exposed to.

·             Stormwater management; including the hydro seeding around the York Valley site, a concept design and detailed design of the stormwater upgrade to allow construction during the 2020/ 2021 summer period, and ongoing discussions with NCC regarding the stormwater discharge abatement notice.

·             Gas management and due diligence on the Pioneer Energy Ltd boiler and gas management system.

·             Two Solid Waste Analysis Protocol (SWAP) studies, the first of these is appended for information.

·             Updated Unique Emission Factor application

·             Site control and automation improvements including site WiFi installation, weighbridge software upgrade, and landfill face camera and thermal image camera installation.

·             Landfill airspace increase development options, including geotechnical stability review.

·             The Provincial Growth Fund (PGF) projects are both underway with the road resurfacing started, and the visual screening planting at Eves Valley Stage 3 awaiting plants.  The final York Valley resealing is planned for 21 February, and the planting at Eves Valley Stage 3 area is scheduled for autumn 2021.

·             Eves Valley Stage 2 Resource Consent pre-hearing meeting and consultation.

·             Management of the landfill while Market Rd was resealed, and assistance to TDC to facilitate waste transport while the TDC Fittal St. transfer station compactor was broken.

·             Meeting with major landfill customers to inform them of upcoming price increases, and discuss the landfill activities.

 

7.       Odour and Litter management

7.1      NTRLBU has had ongoing discussion with one neighbour in regard to litter escaping from NTRLBU’s facilities and getting onto neighbouring land.

7.2      These discussions have identified that the neighbour is open to leasing the key areas of land to NTRLBU to act as a buffer zone for the duration NTRLBU is operating the York Valley Gully 1 Landfill.

7.3      NTRLBU has commissioned an independent market rental assessment for the area of land so that we can proceed further with the negotiation of a lease for the land as buffer zone for NTRLBU activities. It is proposed that NTRLBU leases the land for up to 20 years.

7.4      It is recommended that NTRLBU plants screening plants on the land once it is leased so that litter is captured in the trees and cannot escape further into other properties.

7.5      No odour issues were reported during the period.

8.       Resource Consents

   Stormwater Discharge

8.1      NTRLBU breached the stormwater discharge consent during the last quarter, and an abatement notice was received from NCC. The conditions of the abatement notice required NTRLBU to prepare an erosion and sediment control plan, and provide this to NCC. This was undertaken, and the plan was based on the concept design of the proposed stormwater upgrade, which is currently being designed.

8.2      The NCC compliance representative has been shown around the landfill site, one comment that has been made is that NTRLBU should consider a variation to the consent as the current wording (“conspicuous change”) will mean that NTRLBU is at risk of frequent issues associated with a change in colour from stormwater discharge.

8.3      NTRLBU has seconded a consultant planner to assist with the various resource consent considerations facing NTRLBU.  The planner has begun preparation of a consent variation and a list of actions (earthworks consents) required in relation to the proposed stormwater system upgrades and road realignment.

   Eves Valley Stage 2 Consent

8.4      The consent for the remaining year of capacity at Eves Valley Stage 2 and the consent for the closure of Eves Valley Stage 2 has not been finalised.

8.5      NTRLBU has engaged Nelmac’s landscape architecture personnel to consult with local neighbours regarding the planting plan for the facility. This is currently underway, and following consultation it is hoped that an acceptable plan can be developed and the consent can be finalised.

8.6      A pre-hearing meeting was held on 1 December 2020.

8.7      Consent for the proposed Eves Valley flare needs to be applied for. It has been decided that this can be separate from the Stage 2 consent, as this application has progressed too far to alter it now.  The consent is required to allow the flare for destructing the landfill gas to be installed when required.

9.       ETS management

9.1      An initial review of the carbon emission profile for NTRLBU has been undertaken for the 2020 year to date. This has shown that the use of gas by Pioneer Energy Ltd at the Nelson hospital has reduced during the year, and that NTRLBU will now likely have a UEF factor of 0.932 tonnes CO2 / tonne of waste (still to be audited), which is an increase from 0.885 tonnes CO2 / tonne of waste in the 2019/2020 year. This will result in an increased ETS cost for the year of around $200,000.

9.2      The change to the UEF relates directly to the volume of gas that has been combusted in the hospital boiler.  The volume has reduced because Pioneer Energy Ltd has replaced the burner on the boiler with a more efficient burner.  This has resulted in more efficient combustion, and therefore less gas consumption.

9.3      During this period the GM has received information regarding the Pioneer Energy Ltd Landfill gas system, and prepared a separate confidential report covering this system.

9.4      The first of two SWAP analyses was undertaken in July, and the results have been received.

9.5      A second SWAP analysis was undertaken in mid-November. No result have been received for the second assessment yet.

9.6      The results of the first SWAP study have shown that wastes being received to NTRLBU are higher than the default for organic wastes.

9.7      One implication of this SWAP study result is that NTRLBU will not be able to decrease its ETS liability associated with organic waste discharge, and therefore will not apply for a revised UEF based on waste discharge for the 2020/21 year.

9.8      A second implication of this SWAP study is that the Nelson Tasman region is higher in the key emission causing landfill waste category (organic wastes) than the NZ default value. Feedback from the NTRLBU board is welcomed on what (if anything) it would like the GM to do in order to address this issue.

9.9      The results for organics have reduced since TDC undertook a similar study in 2012, but there is more work to be done in order to reach the required performance.

9.10    The photo below shows the activities associated with the SWAP set up in which the first analysis was undertaken.

9.11    The waste catagories considered are outlined below

10.     Landfill life

10.1    At present the landfill life if NTRLBU continue activities as normal, is approximately 10 years. 

10.2    An opportunity was identified which could lead to a significant increase in landfill airspace. NTRLBU has engaged a consultant to develop this idea and to undertake the geotechnical review required to further progress this option. Tentative early indications are that this may be feasible, and that the factor of safety will able to be maintained at the current levels.

11.     Finances

11.1    Landfill volumes have recovered back to pre-COVID 19 levels, and have exceeded our expected landfill volumes for the year to date.

 

11.2    Income Account for the period to 30 September 2020.

11.3    The income account of the September Quarter 2020 shows an operating surplus of $258,000 excluding PGF funding gains compared to a budget surplus of $20,000 for the same period.

11.4    This increased income has come principally from the increase volume of wastes being received compared to the projected volumes used to generate the budget.

11.5    The overall surplus for the year to 30 September is $594,604, including the funding gained for PGF projects.

12.     Business Plan and Activity Management Plan

12.1    The Revised NTRLBU Business Plan and Revised NTRLBU Activity Management Plan 2021 – 2031 are covered by a separate report.

13.     NTRLBU Resourcing

13.1    Review of regional services capital programme and development works has identified that the current staffing level is unlikely to allow effective delivery of all capital development activities.

13.2    The GM proposes to prepare a request to the NCC CEO for additional Capital Works Project Manager to assist with delivery of the programme.
