The Chairperson noted a change to the recommendation for Item 10 – Nelson Future Access: Memorandum of Understanding (MoU), in that this was now a recommendation to Council, reflecting the correct delegations.

Chairperson’s Report

The Chairperson gave an update. Topics included matters discussed at the South Island Regional Transport Committee (RTC) Chairs meeting, the recent workshop with the Ministry of Transport (MoT) and the Targeted Enhanced Funding Assistance Rate (TEFAR).

The death of Tasman Wheelers Cycle Club member Ann Rigg, who was killed whilst riding on State Highway 6, was acknowledged.

The Chairperson invited NZTA representative, Jim Harland, to update the meeting regarding the TEFAR initiative and Mr Harland answered questions on the matter.

Discussion took place on Council’s concerns regarding freight, mode neutrality and the prioritisation of rail as a preference. Mr Harland acknowledged that the current focus of the South Island Chairs group was on increasing freight to rail and that the NZTA was looking at the long term view for the transport network in a broader sense and at critical resilience and that not all freight was suitable for rail. The importance of Port Nelson being involved in discussions for the focus of freight in the South Island was noted.

A briefing paper on tourism flows was requested for the next Regional Transport Committee meeting.

Further discussion took place regarding the various inadequacies of the recent MoT workshop and it was noted that the MoT should not consider that meeting as proper consultation, nor as the formal views of the RTC or Nelson Council. There was general consensus that the the meeting was not well handled by the MoT including the venue and meeting invitations. The Committee noted that the MoT should engage further with Council on matters relating to the Government Policy Statement on land transport (GPS).

Her Worship the Mayor advised that she would share Council’s disappointment with the MoT engagement process with the Chief Executive of the MoT, that she had raised the issue with the Chief Executive of Local Government New Zealand (LGNZ) and would pursue it through the LGNZ zone and sector meetings.

It was emphasised that uncertain funding had significant implications on Council’s programme of work to advance public transport, which it had committed on through the Regional Land Transport Plan (RLTP).

The meeting was adjourned at 2.15p.m. and reconvened at 2.23p.m.

There was discussion regarding the Chairperson of the Regional Transport Committee writing a letter to the MoT outlining Council’s disappointment regarding the existing engagement on the development of the GPS and its future expectations regarding engagement. It was noted that a recommendation relating to the letter would be considered later in the meeting.

7.       New Zealand Transport Agency Update

Steve Higgs of the NZTA spoke to the report and answered questions. Mr Higgs noted that with respect to noise mitigation that there was a national programme for noise management which included all regions, as well as Nelson, but that unfortunately, Nelson had not been included on the list.

Mr Higgs spoke about changes to NZTA priorities, he said the Noise Enhancement Programme had received no funding and was unlikely to proceed. He advised that the NZTA was developing further thinking on this matter, which would take some time.

It was requested that the minutes record Council’s disappointment with this information.

·   the health issues

·   modelling and thresholds

·   lack of alternative programmes available to Council

·   benefit cost ratios for the future

·   speed limit setting rules and work undertaken in our zone so that temporary speed reductions can be set

·   onus on the NZTA to communicate with communities as to why the work consulted on will not be proceeding

·    a request that Council’s frustration be communicated to the NZTA board.

6.1     Letter to the Ministry of Transport (Chairperson’s Report revisited)

Further discussion took place on the proposed letter to the MoT. Her Worship the Mayor Reese advised that she would engage with the Chairperson of the NZTA again.

That the Regional Transport Committee

1.     Approves that the Regional Transport Committee Chairperson write to the Ministry of Transport, specifically noting:

(a)     The Regional Transport Committee’s disappointment with the Ministry of Transport’s process, particularly its lack of formal notification to all Regional Transport Committee members with respect to the 25 March 2019 workshop held at Nelson City Council offices; and

(b)     The discussions that took place at the 25 March 2019 workshop should not be taken to be feedback from the Nelson City Council or the Nelson Regional Transport Committee; and

(c)     The Nelson Regional Transport Committee’s request to the Ministry of Transport for further engagement, including the provision of all material in advance of any meetings/workshops and that any  feedback from the Nelson Regional Transport Committee from this process be formally acknowledged and responded to;

2.     Approves that the Chair of the Regional Transport Committee provide feedback to the Ministry of Transport on the Government Policy Statement 2018: Revised Draft Measures, noting that the Regional Transport Committee will retrospectively approve the submission at the next Regional Transport Committee, currently scheduled for 1 July 2019.

8.       Nelson Future Access Detailed Business Case Update

Group Manager Infrastructure, Alec Louverdis, advised of an amendment to the agenda report to add the word ‘scope’ to the end of the sentence on paragraph 2.1, page 25.

Rhys Palmer, NZTA, provided an update, noting that the NZTA had awarded the contract for this work to Aecom NZ, partnered with Stantec. He said that the project was 21 working days behind schedule.

Mr Palmer said that the NZTA had met with Council’s planning team to discuss consistency between the Nelson Plan work currently underway and the Nelson Plan Future Access project.

He spoke about the first deliverable on agenda page 34, and confirmed that this would be considered at the first working group meeting.

Mr Palmer tabled a new timeline schedule which superseded the one in the agenda. He noted the project was a month behind, that Rocks Road was the critical deliverable and that the NZTA had set out to complete the Single Stage business case prior to the local body elections. He said that the scope document put to the steering group would discuss whether consultation on Rocks Road was required. A decision would be made in early May, and if consultation was required it would be difficult to make a decision prior to the elections.

In reply to a question about delegations, Mr Palmer noted that a list of delegations was included in the tender documents. Mr Louverdis undertook to forward the list to the Governance Group.

It was also noted that the stakeholder and community engagement list needed further consideration to ensure that stakeholders in the red area on the map would be included and would be refined with officers.

Mr Palmer said that the budget for this investigation was committed, no implementation money was involved, however there was some probable implementation budget for Rocks Road.

1.       Purpose of Report

1.1       To provide the Committee with the New Zealand Transport Agency (NZTA) update on the status of the Atawhai Speed limit review and other matters.

3.       Background

3.1       At the 3 October 2018 Regional Transport Committee (RTC) meeting it was noted that speeds and resulting safety issues remained a big community concern on SH6 Atawhai. The committee resolved to

Requests that the New Zealand Transport Agency considers a reduced speed limit along SH6 between Haven Road and Todd Bush Road and report their findings back to a future Regional Transport Committee meeting. 

4.       Discussion

4.1       In April 2019 the RTC submitted feedback to the NZTA on proposed Blenheim to Nelson Safety Improvements. Included in that feedback was commentary that the committee was disappointed to see that the speed limit review of State Highway 6 north of Nelson at Atawhai barely rated a mention in the proposal and was not proposed as a “quick win.”         

4.2       In April 2019 the Mayor wrote to the then NZTA Board chairperson Mr Michael Stiassny expressing Councils ongoing concern and requesting the Blenheim - Nelson speed review be brought forward.

4.3       The New Zealand Transport Agency’s Update report is included as Attachment 1 and includes reference to the reply received from NZTA on the speed limit review amongst other updates.

Update on South Island Visitor Flows Project

     

 

1.       Purpose of Report

1.1       To update the Nelson Regional Transport Committee (RTC) on the South Island Visitor Flows Project and the next steps.

 

 

 

2.       Recommendation

 

That the Regional Transport Committee

3.       Background

3.1       The Nelson Regional Land Transport Plan (RLTP) includes $10,000 per year contribution to the South Island Regional Transport Committee Chair Group initiatives.

3.2       During 2017/18 the South Island RTC Chairs group commissioned a report to consider the development of a visitor flow model on the South Island transport network. This work is now complete and is published through the NZTA, ‘Understanding current and forecast visitor flows to the South Island October 2018’.

 

4.        Discussion

4.1       This study identified a multitude of data but no one definitive measure, especially at a regional level. The study identified three areas for further work:

4.1.1        The need to act on the component of the national tourism strategy that seeks better dispersal, across regions of visitors and of tourism benefits, in order to accommodate forecasted visitor numbers.

4.1.2        The need to better plan the infrastructure required to accommodate these forecasted numbers, and to make best use of the South Island’s transport network including, but not limited to, transport infrastructure.

 

4.1.3        The need, when planning infrastructure for visitors, to think about the infrastructure required along the journey, as well as the infrastructure required at tourist destinations. Although tourism management in New Zealand has largely been focusing on marketing and managing the destination, the journey itself is also a key part of visitor experience

 

3.2       The next stage is for the South Islands Chairs Group to engage a consultant to undertake this work. Multiple agencies are looking at similar types of projects and work is being undertaken to link projects up. Funding through NZTA is being explored and once the scope is finalised the project will go out to tender.

1.       Purpose of Report

1.1       To retrospectively approve the submission from the Regional Transport Committee (RTC) to the Ministry of Transport (MoT) on the Government Policy Statement (GPS) 2018: Revised draft measures.

 

 

2.       Recommendation

 

That the Regional Transport Committee

1.     Receives the report Submission to Ministry of Transport Government Policy Statement 2018 : Revised draft measures (R10207) and its attachment (A2187966); and

2.     Approves retrospectively the submission from the Regional Transport Committee chair to the Ministry of Transport (A2197966 to report R10207).

 

 

3.       Background

3.1       The RTC resolved on 12 April 2019 as follows:

Approves that the Chair of the Regional Transport Committee provide feedback to the Ministry of Transport on the Government Policy Statement 2018: Revised Draft Measures, noting that the Regional Transport Committee will retrospectively approve the submission at the next Regional Transport Committee, currently scheduled for 1 July 2019”.

Important considerations for decision making

1.   Fit with Purpose of Local Government

The Draft GPS is a requirement under the Land Transport Management Act 2003 legislation.

2.   Consistency with Community Outcomes and Council Policy

The Draft GPS is a guiding document for Council’s RLTPs and Transportation AMPs. It is a requirement that all documents give effect to the direction of the Draft GPS.

3.   Risk

Not providing feedback to the MoT on assessment measures risks perception that Council is disinterested and/or that the final approved measures do not take Council view into consideration.

4.   Financial impact

Providing feedback on draft measures on the key priorities of the Draft GPS acknowledges measurement of progress is important in securing funding and if inappropriate could affect future funding.

5.   Degree of significance and level of engagement

This matter is of low significance. The MoT has engaged with all Regional authorities inviting feedback.

6.   Inclusion of Māori in the decision making process

Maori were not consulted on with respect to this report or the draft submission.

7.   Delegations

The Regional Transport Committee has specific delegation to:

·      To approve submissions to external bodies on policy documents likely to influence the content of the RLTP.

2017/18 Annual Monitoring Report on the Regional Land Transport Plan 2015-2021

     

 

1.       Purpose of Report

1.1       To receive the 2017/18 Annual Monitoring Report on the Regional Land Transport Plan 2015-2021

 

 

 

 

2.       Recommendation

 

That the Regional Transport Committee

1.     Receives the report 2017/18 Annual Monitoring Report on the Regional Land Transport Plan 2015-2021 (R10262) and its attachment (A2015759)

 

 

 

3.      Background

3.1     Section 16(3)(f) of the Land Transport Management Act 2003 requires measures to monitor the performance of the activities identified in the Regional Land Transport Plan.  Appendix 3 of the Regional Land Transport Plan details the Regional and Nelson monitoring indicators and targets and states that the monitoring will be reported annually.

3.2     An administrative oversight resulted in this monitoring report not being presented to the RTC in late 2018.  Although later than usual this data will provide context for subsequent monitoring reports and meets the expectation stated in the Plan that monitoring will be reported annually.

3.3     Officers have commenced compiling the 2018/19 report which will come to the RTC in late 2019.  Steps have been put in place to avoid any repeat of late reporting. 

4      Discussion

4.1     The monitoring report is attached as A2015759.

5        Conclusion

5.1     The presentation of the monitoring report is required by the Regional Land Transport Plan.  It is recommended that this report be received.

Regional Land Transport Plan variation - Nelson State Highway Speed Management Guide Implementation

     

 

1.       Purpose of Report

1.1       To approve varying the Regional Land Transport Plan 2015–21 (Mid-Term review) (RLTP) to include the Nelson State Highway (SH) Speed Management Guide (SMG) Implementation.

 

 

2.       Recommendation

1.     Approves that the Nelson Regional Land Transport Programme 2015-21 is varied to include a total of $1.26M for Nelson State Highway Speed Management Guide Implementation over 2018-2021 with a 100% Funding Assistance Rate  

 

 

 

3.       Background

3.1       In June 2018 the Regional Transport Committee (RTC) submitted to the NZ Transport Agency (NZTA) the RLTP (Mid-Term Review) that detailed its funding priorities for the next three years.

3.2       As progress is being made on the national roll out of the Safe Networks Programme (SNP) NZTA now wish to progress implementation of a SMG on the Nelson SH as outlined in the appended NZTA report, (Attachment 1). This project needs to be included in the RLTP to be eligible for National Land Transport Plan (NLTP) funding.

3.3       NZTA advise that implementation of the SMG is already identified as a project in the Tasman District Council RLTP and that they are working closely with the Marlborough District Council to seek inclusion in their RLTP as soon as possible.

4.       Discussion

4.1       The Nelson SH Speed Management Guide Implementation activity is estimated to cost $1.26millon in total (over 3 years) with a 100% Funding Assistance Rate.

4.2       This variation is low cost and is not significant. Public consultation to include it in the RLTP as a variation is not required.

Important considerations for decision making

1.   Fit with Purpose of Local Government

Providing an RLTP is a requirement of the Land Transport Management     Act 2003.

2.   Consistency with Community Outcomes and Council Policy

The development of an RLTP contributes to the community outcome “Our infrastructure is efficient, cost effective and meets current and future needs”. The RLTP must align with the Draft Government Policy Statement (GPS).

3.   Risk

Risks associated with making variations to the RLTP and any consequential changes are mitigated by changes being processed in accordance with section 18D of the Land Transport Management Act 2003.

4.   Financial impact

The project in question is an NZTA State Highway project and will have no effect on the LTP or rates.

5.   Degree of significance and level of engagement

The $5M significance level has not been triggered by the proposed variation for so consultation is not required.

6.   Inclusion of Māori in the decision making process

No engagement with Māori has been undertaken in preparing this report.

7.   Delegations

The RTC has the responsibility for preparing the RLTP and RPTP in accordance with the requirements of the LTM Act 2003. The RTC functions include:

        “To prepare a Regional Transport Plan, or any variation of the Plan, for    

         the approval of Council”.
