Ms Malcom tabled photographs supporting her public forum submission, noting that she was also speaking on behalf of Nelsust. Ms Malcolm highlighted concerns regarding the danger to cyclists caused by parked cars, particularly on streets serving schools, and encouraged Council to consider reducing parking to facilitate cycle lanes on these streets.

Senior Property Officer, Susan Mathieson, advised that since the writing of the report, written support had been provided from all affected neighbours.

In response to questions Senior Asset Engineer - Transport and Roading, Paul Devereux,  noted that staff had completed due diligence on the impact now, and in the future, and that any future cases would be treated on case-by-case basis. Mr Devereux also noted that Council was bound by legislation regarding the road stopping process.

Item 7: Great Taste Trail - Hounsell Circle to Tahuna Beach Holiday Park

Great Taste Trail - Hounsell Circle to Tahuna Beach Holiday Park

     

 

1.       Purpose of Report

1.1       To approve a change of use of road reserve land to facilitate the proposed route of the Nelson Tasman Cycle Trails Trust’s Great Taste Trail from Hounsell Circle to Tahuna Beach Holiday Park.

2.       Summary

2.1       The Tahunanui to Parkers Road Shared Pathway is the first stage of extending the Great Taste Trail from the Nelson Airport to the Nelson     i-Site via Tahunanui. This project will provide a scenic link from the Airport to Tahuna Beach and will eventually provide an alternative safe biking route to the city centre. This report deals with the proposed route along one section of the project, from Hounsell Circle to the Tahuna Beach Holiday Park.

2.2       The Beach Road option (Option D) requires reconfiguration of road space currently used for angled car parking. It is the preferred option of the Nelson Tasman Cycle Trails Trust and is supported by Bicycle Nelson Bays, the Tahunanui Business Association and Council officers. It is not opposed by Nelson Bays Football, the principal user of the adjoining sports field.

2.3       Frequent but informal observation of car parking use on the affected section of Beach Road over the last six months indicates that the effects of the reduction of parking from 65 spaces to 29 will not have a significant impact and is outweighed by the benefit of recreational cycling in the region.

2.4       It is recommended that the Nelson Tasman Cycle Trails Trust be advised that their proposed route, Option D along Beach Road, be supported and that they work with Council officers to ensure that this trail integrates with the proposed Tahunanui on-road cycling route.

 

 


 

3.       Recommendation

2.       Approves the reconfiguration of road reserve space to accommodate reduced parking and the proposed Great Taste Trail from Hounsell Circle to Tahuna Beach Holiday Park generally as shown as Option D on Figure 2 Tahuna Beach Reserve Options.

 

 

4.       Background

4.1       The Tasman Cycle Trails Trust is preparing to construct the section of the Great Taste Trail from Hounsell Circle on Tahuna Beach Reserve to the end of Parkers Road along the seaward side of the Tahuna Beach Holiday Park.

4.2       A total of $804,000, including 50% from the Ministry of Business Innovation and Employment, is included in the Long Term Plan for years 2018/19 and 2019/20, to complete the entire section through to the raised bridge over Jenkins Stream beside the Airport. This will link Tahuna Beach Reserve onto the Wakatu Drive shared pathway, a section of the Great Taste Trail to Tapawera and Kaiteriteri. It is expected that the new section of trail will eventually link back to the Nelson CBD by continuing alongside Rocks Road to join the newly completed section from Rutherford Park to the Early Settlers Memorial on Wakefield Quay.

4.3       Negotiations for access over Nelson Golf Course and Nelson Airport as part of the next Tahunanui section of trail are ongoing and are not expected to be resolved in this financial year. This report only addresses the section from Hounsell Circle to the Tahuna Beach Holiday Park.

5.       Discussion

5.1       Attachment 1 “Figure 1, Tahunanui Pathways and Great Taste Trail’ shows the relationship between the proposed Great Taste Trail extension and the Tahunanui Pathways on-road route.

·    *1 to *2 shows the existing shared pathway through Tahuna Beach Reserve

·    #5 to *6 shows the existing Airport Link to the Whakatu Drive shared pathway

·    *2 to *5 shows the extent of the new trail proposed by the Nelson Tasman Cycle Trails Trust to link Tahuna Beach Reserve with the Whakatu Drive Shared Pathway and the Great Taste Trail.*4 to *5 is still a proposed route only and has not been confirmed with the Nelson Golf Club and the Airport.

5.2       The route continuing west of the BMX Track is largely included within the lease of the Tahuna Beach Holiday Park and has been agreed between the Cycle Trails Trust and the Tahuna Beach Camp Society Incorporated. The track, extending through to Parkers Road, will comprise mostly of gravel path but with some sections extending over the edge of the estuary constructed of open section fibre reinforced plastic surfacing which reduces water impact during storms.

5.3       Four options have been considered for the section of trail from Hounsell Circle to *3 beside the BMX Track (Attachment 1, Figure 1) These are shown above in Figure 2 and were proposed in the attached application from the Nelson Tasman Cycle Trails Trust, (Attachment 2). Only two are considered viable, options B (Modellers Pond Option) and D (Beach Road Option).

5.4       Option A was discarded because of the high numbers of pedestrians and poor visibility along the footpath immediately adjacent to the north side of Natureland and the central carpark area.

5.5       Option C was discarded because it reduced the area of open grass space available for sport. The cycle trail would eat into the critical width requirement thereby preventing future adult competition football from taking place.

6.       Options

Modellers Pond Option

6.1       This route, Option B, leaves the existing shared path alongside the sports fields on Tahuna Beach Reserve beside Waikare Street, travels through the car park beside the Modellers Pond, and joins the path over the rail crossing and pond outlet to the Tahuna Beach Holiday Park. (Refer to Figure 2 ‘Tahuna Beach Reserve Options’.)

6.2       This route over the existing shared path may have more interesting features to look at but is already well used by pedestrians and cyclists during summer weekends. To compensate, the path would need to be widened from the existing 1.4 metres to 2.5 metres.

6.3       The Society of Modellers has expressed some concern regarding the increased numbers using the rail crossing but has agreed to advise and work with the Trails Trust on a crossing solution if this becomes the preferred option. 

Beach Road Option

6.4       This route, Option D, travels from Hounsell Circle, joins Beach Road at the Waikare Street corner and travels through the current angle car parking adjacent to the park to the start of the Holiday Park. Reconfiguration of parking to create cycleway space and parallel parks will result in the loss of 36 car parks. (Refer to Figure 2 ‘Tahunanui Reserve Options’, above, and included in Attachment 2.)

6.5       In the past, recommendations to reduce carparks elsewhere in the City have resulted in concern expressed by affected parties. However, in this case, informal observation of car parking use in this area undertaken regularly over the last six months, including the Christmas period, indicates that apart from times of major events the removal of 36 car parks of a total of 65 existing is not expected to have a significant impact on general parking demand in the area. These observations along this section of Beach Road indicate in the order of 13 vehicles parking on the north side and 17 on the south side. The section east of Waikare Street is more intensely parked during weekend sport.

 

 

6.6       The Trails Trust consulted (10 January 2019) with property owners (three) or tenants (nine) between 49 and 79 Beach Road. They were either supportive or had no comment on the proposal.

6.7       Nelson Bays Football, main user of the adjoining sports field has been advised of a possible loss of car parks. Their Chief Executive has responded that 29 parks immediately adjacent to the field is adequate for their needs. Football would support either the Modellers Pond or Beach Road options.

6.8       In peak times, such as for the ‘Weet-Bix Kids Tryathlon’, nearby parking demand greatly exceeds supply, but events of this magnitude are not a regular occurrence.

6.9       Beach Road (Option D) is the preferred option of the Nelson Tasman Cycle Trails Trust, is supported by Bicycle Nelson Bays and is compatible with the separate Tahunanui Pathways on-road route aimed at an ‘interested but concerned’ user group of cyclists.

6.10     Chris Allison, Bicycle Nelson Bays representative on the Tahunanui Pathways on-road route working party, has stated that their preference is Option D, Beach Road because of a potential for walker/cyclist conflict along the Modellers Pond route. He understands concern over reducing car parks but believes that if Option B, Modellers Pond, becomes the chosen option, widening the existing shared path would overcome possible conflict.

6.11     The future Tahunanui Pathways on-road route beyond the Waikare Street/Beach Road corner has yet to be confirmed but in the meantime will use the existing shared path further along Waikare Street through Tahuna Beach Reserve, the same route as the Cycle Trails Trust.

6.12     Beach Road is also the preferred route of the Tahunanui Business Association. The Association further believes that narrowing the total road space will result in lower speed through that section of Beach Road.

 

Option 1 (B): Modellers Pond

Advantages

·   Interesting route for users through the reserve

·   Maintains existing carpark numbers

Risks and Disadvantages

·   Possible conflict with pedestrians during peak times (but can be reduced with path widening)

·   Crosses the model train tracks with potential conflict between cyclists and trains (but can be managed with miniature crossing detail)

·   Marginally more expensive to construct

Option 2 (D): Beach Road  (this is the preferred option)

Advantages

·    More direct route

·    Avoids pedestrian conflict

·    No conflict with trains

·    Preferred by the Tahunanui Business Association

·    Preferred by Bicycle Nelson Bays

·    Marginally cheaper to construct

·    Supported by Nelson Bays Football (sports ground user)

Risks and Disadvantages

·    Reduces available car parking from 65 car parks to 29

·    Not as interesting as Option 1 as it travels along the roadside rather than through the reserve

 

7.       Conclusion     

7.1       The Beach Road option is the preferred option of the Nelson Tasman Cycle Trails Trust and is supported by Bicycle Nelson Bays. It is not opposed by Nelson Bays Football, principal users of the adjoining sports field. This route is likely to cause less conflict than the Modellers Pond option. Observation of car parking use over the last six months indicates that the removal of 36 car parks of a total of 65 existing is not significant and is outweighed by the benefit of recreational cycling in the region.

7.2       It is recommended that the Nelson Tasman Cycle Trails Trust be advised that Council supports the reconfiguration of road reserve space to accommodate reduced parking and the proposed Great Taste Trail between Hounsell Circle and Tahuna Beach Holiday Park. The proposed route, Option D along Beach Road, is supported and the Trust is asked to work with Council officers to ensure that this trail integrates with the proposed Tahunanui Pathways on-road cycling route.

1.   Fit with Purpose of Local Government

This project will meet the needs of the Nelson community and visitors to the region for a recreational cycling experience. It will link Tahuna Beach Reserve and the Tahuna Beach Holiday Park to the Great Taste Trail alongside Wakatu Drive.

2.   Consistency with Community Outcomes and Council Policy

This recommendation aligns with the Long Term Plan decision to subsidise this extension of the Great Taste Trail.

Supports the Community Outcome of:

‘Our communities have access to a range of social, educational and recreational facilities and activities’

3.   Risk

The risk of this project not succeeding is low.

4.   Financial impact

A budget of $804,000 is included in the Long Term Plan over 2018/19 and 2019/20 with 50% funded from the Ministry of Business Innovation and Employment.

5.   Degree of significance and level of engagement

This matter is of low significance because the remaining parking will meet the needs of the adjoining reserve and local residents.

6.   Inclusion of Māori in the decision making process

No engagement with Māori has been undertaken in preparing this report.

The Works and Infrastructure Committee has the following delegations to consider the replacement of car parking with a cycle trail along Beach Road.

Nelson Regional Sewerage Business Unit Wastewater Asset Management Plan

     

 

1.       Purpose of Report

1.1       To receive and approve the Nelson Regional Sewerage Business Unit (NRSBU) Asset Management Plan (AMP) following approval of the NRSBU Business Plan.

3.       Background

3.1       The NRSBU was established by Nelson City Council (NCC) and Tasman District Council (TDC) to manage and operate regional sewage assets and is required under the agreed Memorandum of Understanding to submit the AMP to the two Councils for approval.

3.2       Following a workshop in June 2017 attended by NRSBU representatives, NCC and TDC officers, representatives of the five contributors and the operations contractor, an AMP was developed which was considered by the NRSBU at their meeting held on 15 September 2017 where they resolved:

“That the Nelson Regional Business Unit Asset Management Plan be adopted, as amended.”

3.3       The revised NRSBU 2018-19 Business Plan incorporating Nelson’s Long-Term Plan and environmental aspirations was approved by Council on 13 December 2018 here they resolved:

“Approves the Nelson Sewerage Business Unit Business Plan 2018-19 (A2086495) noting that this now better reflects Nelson City Council’s Long Term Plan and Nelson City Council’s environmental aspirations”.

3.4       The AMP has been updated to reflect the Business Plan and is appended as Attachment 1 – All changes reflecting the approved Business Plan are highlighted in yellow. 

4.       Discussion

4.1       The AMP developed was used to support the 2018/2028 Long Term Plans of the two Councils and includes the following detail:

·   Areas of focus for the activity during 2018-28;

·   Levels of Service;

·   The activity budgets for operations and maintenance, renewals and capital expenditure.

4.2       The AMP provides analyses of the assets and services delivered by the NRSBU to its customers, future demand, and financial analysis of the NRSBU operations and outlines how risk is managed.

4.3       The AMP plan identifies the renewal of the consents for the discharge of treated wastewater and biosolids as the most significant issues facing the NRSBU in the medium term (2 to 10 years) and the response to climate change as a significant issue in the longer term (30+ years).

5.       Options

5.1       Two options are considered – either approve or not approve the AMP. The preferred option is for Council to approve the AMP.

 

Option 1: Approve the AMP

Advantages

·   Give effect to the MOU and demonstrates support for the joint committee.

·   Supports Council in meeting the requirements of the LGA. 

Risks and Disadvantages

·   Nil

Option 2: Do not approve the AMP

Advantages

·    Nil

Risks and Disadvantages

·    Not approving the AMP would leave Council without a clear plan to mitigate risks and achieve levels of service.

 

6.       Conclusion

6.1       The NRSBU has resolved that the AMP be adopted. This Council had approved the NRSBU Business Plan and the AMP has been updated accordingly. The AMP needs to be approved by the two Councils.

Important considerations for decision making

1.   Fit with Purpose of Local Government

The AMP sets out how Council will deliver agreed levels of service to the community in the most cost effective way.

2.   Consistency with Community Outcomes and Council Policy

The AMP supports the delivery of the following Council Community Outcomes:

·    Our infrastructure is efficient, cost effective and meets current and future needs

·    Our communities are healthy, safe, inclusive and resilient

The decision to accept this AMP is consistent with the Memorandum of Understanding and is not considered to be inconsistent with any decisions of Council.

3.   Risk

Adopting the AMP is a low risk as it has been through a thorough development process and reflects all of the relevant LTP decisions. Adopting the AMP helps Council mitigate risks by providing a clear plan to achieve levels of service, address relevant focus areas and sets activity budgets for operations, maintenance, renewals and capital expenditure.

4.   Financial impact

There are no direct funding implications for NCC from the recommendation. Programmes and projects that will be implemented through the plan will be funded by the users of regional wastewater services.

5.   Degree of significance and level of engagement

This matter is of low significance because the AMP is consistent with the 2018/19 Business Plan used to inform the two Councils’ respective 2018/2028 LTPs.

6.   Inclusion of Māori in the decision making process

No consultation with Māori was undertaken with respect to this report. The iwi representative on the joint committee resigned from the committee earlier in the year and was therefore not present at the workshop or meeting where the Draft AMP was considered.

Nelson Tasman Regional Landfill Business Unit Terms of Reference and Nelson Regional Sewerage Business Unit Memorandum of Understanding

     

 

1.       Purpose of Report

1.1       To receive the Nelson Tasman Regional Landfill Business Unit (NTRLBU) Terms of Reference and Nelson Regional Sewerage Business Unit (NRSBU) memorandum of Understanding report, and to recommend to Council approval, subject to approval by Tasman District Council.

 

 

 

2.       Recommendation

 

That the Works and Infrastructure Committee

1.       Receives the report Nelson Tasman Regional Landfill Business Unit Terms of Reference and Nelson Regional Sewerage Business Unit Memorandum of Understanding (R10053) and its attachments (A2144233 and A2144291).

Recommendation to Council

That the Council

1.       Approves the revised Nelson Tasman Regional Landfill Business Unit Terms of Reference (A2144233), Attachment 1 of report R10053; and

2.       Approves the Nelson Regional Sewerage Business Unit Memorandum of Understanding (A2144291), Attachment 2 of report R10053; and

3.       Removes the requirement for a separate audit of the annual reports of the Nelson Tasman Regional Landfill Business Unit and the Nelson Regional Sewerage Business Unit, subject to similar approval by Tasman District Council.

 

 

2.       Background

2.1       The existing Terms of Reference for the NTRLBU and the Memorandum of Understanding of the NRSBU require a separate audit of their Annual Report and Accounts.

2.2       The Auditor of the two Business Units has questioned the need and cost benefit of having the Annual Report and Accounts audited.

2.3       Tasman District Council’s Corporate Services Manager advised that the separate audit would not provide good value, given the cost and time involved and recommended that this requirement be removed from the Terms of Reference/Memorandum of Understanding.

2.4       At the request of Audit New Zealand, a clause has been included in both the NTRLBU Terms of Reference and the NRSBU Memorandum of Understanding, to clarify the basis of charges from each Council to both business units for services provided.

2.5       The NTRLBU and NRSBU separately met on 8 March 2019 and received reports recommending removing the requirement of a separate Audit.

2.6       The NTRLBU resolved:

“Recommends to Nelson City Council and Tasman District Council that the proposed amendment removing the requirement for a separate audit of the annual report is approved.”

2.7       The NRSBU resolved:

“Recommends to Nelson City Council and Tasman District Council that the proposed amendment removing the requirement for a separate audit of the annual report is approved.”
