Road Closures - All Blacks/Argentina Rugby Game and City Activation - 8 September 2018

     

 

1.       Purpose of Report

1.1      To consider and decide on the temporary road closure applications for the following events:
•  All Blacks/Argentina International rugby match on 8 September 2018.
•  City Activation on 8 September 2018.

 

2.       Recommendation

That the Hearings Panel - Other

Approves the road closures required for the All Blacks/Argentina International rugby game and City Activation on 8 September 2018 as detailed in report R9327.

 

 

3.       Background

3.1      It is a requirement that temporary road closures made under Schedule 10 Clause 11(e) of the Local Government Act 1974 come to the Hearings Panel - Other for approval.

4.       Discussion

          All Blacks/Argentina International Rugby Test

4.1      On 13 April 2018, the Tasman Rugby Union applied for the closure of the roads listed below for the test match to be held on 8 September 2018:

·         Hathaway Terrace, Hathaway Carpark and Trafalgar Park Lane from 6am on 7 September until 11pm 8 September 2018

·         Paru Paru Road 6am until 11pm on 8 September 2018

·         Trafalgar Street (SH6-Halifax Street), Wainui Street, Grove Street (Collingwood – Trafalgar) and Elliot Street from 4pm until 11pm on 8 September 2018

·         Trafalgar/Halifax Intersection closed as required from approximately 9:15pm until 11pm under the control of the STMS, Police and NCC staff.

4.2      Council placed a notification in Our Nelson which was circulated on 30 May to notify of the applicant’s intention to close these roads, and asking the public for feedback by Thursday 14 June 2018. The advertisement was also posted on Council’s website. No feedback was received.

4.3      This event does not require a resource consent for noise.

4.4      The applicant has shown evidence of adequate public liability insurance.

4.5      Council officers are providing the applicant with the required traffic management plan and Safe Traffic New Zealand have been selected by the applicant to implement this plan.

4.6      Council officers recommend that this application be approved.

          City Activation

4.7      On 2 May 2018, the Nelson Regional Development Agency (NRDA) applied for the closure of the roads below for the City activation before and during the test match to be held on 8 September 2018:

·         Trafalgar Street (Bridge Street to Hardy Street), Hardy Street (Church Street to Collingwood Street), Park Street and Morrison Street 11am until 7pm; and

·         Trafalgar Street (Hardy Street to Selwyn Place) and Morrison Street 11am until midnight.

4.8      Council placed a notification in Our Nelson which was circulated on 30 May to notify of the applicant’s intention to close these roads, and asking the public for feedback by Thursday 14 June 2018. The advertisement was also posted on the Council website.

4.9      Feedback was received as follows:

The Sprig and Fern have asked if the closure of Hardy Street could be maintained until midnight to allow them to host a street party. Police and other parties have raised concerns about safety and security of this proposal. The NRDA have proposed to the Sprig and Fern that they could host this party in Morrison Square and are still in discussion regarding this.

4.10    Concern has been raised by the applicant’s traffic consultant (Safe Traffic New Zealand) around availability of parking in the CBD, as Trafalgar Street and Bridge Street are planned to be closed and have no parking from 6am during the time the Saturday Nelson Market is occupying Montgomery carpark. However, officers do not share that concern based on past experience when similar roads and Montgomery Square were closed to traffic as part of the Royal tour in November 2016. On that occasion people parked elsewhere around the City.

4.11    The applicant has shown evidence of adequate public liability insurance.

4.12    Council officers are providing the applicant with the required traffic management plan.

4.13    Council officers recommend that the application for road closures associated with this event be approved.

5.       Options

5.1      The Hearings Panel has two options, either to approve or decline the temporary road closure applications.  Officers recommend approving both temporary road closures.

Important considerations for decision making

1.   Fit with Purpose of Local Government

·    The temporary road closures fit with the purpose of local government.

2.   Consistency with Community Outcomes and Council Policy

These events contribute to our community outcomes by assisting our community to celebrate their identity and community.

3.   Risk

Enabling these events to proceed requires temporary road closures. If the temporary road closures are not approved, these community events are at risk of not going ahead.

4.   Financial impact

There is no financial impact to Council for those road closures.

5.   Degree of significance and level of engagement

This matter is of medium significance because of the number or people affected and the short duration of the events. A request for feedback was advertised in Our Nelson and on the Council’s website. Further communication will be made with the public once details of the City Activation event logistics have been confirmed.

6.   Inclusion of Māori in the decision making process

Māori have not been consulted on this matter.

7.   Delegations

The Hearings Panel - Other has the responsibility to:

“consider and determine applications for temporary road closures made under Schedule 10 Clause 11(e) of the Local Government Act 1974”.

Parking and Vehicle Control Bylaw (2011), No 207 Amendments to Schedules

     

 

1.       Purpose of Report

1.1      To approve proposed alterations to Schedules of the Parking and Vehicle Control Bylaw (2011), No. 207, to give effect to minor safety and parking improvements, roading improvements carried out as part of the capital works programme and changes arising from new subdivisions.

 

2.       Recommendation

Approves amendments detailed in the report R9450 to the following Schedules of the Bylaw, Parking and Vehicle Control (2011) No 207:

3.       Background

3.1      The Parking and Vehicle Control Bylaw 2011 allows for the Council by resolution, to add, amend or delete specifications contained in the Schedules.  The Council has delegated this power to the Hearings Panel (other). To ensure that the Bylaw is enforceable it is important to ensure that the Schedules are updated on a regular basis.  The Bylaw Schedules were last updated in February 2018.

3.2      Minor alterations and additions are proposed to Schedules 4, 8, 9 and 14 of the Bylaw as detailed in section 4.

3.3      The proposed alterations and additions are shown for indicative purposes only by plans attached to this report.  The purpose of these plans is to assist the Panel to easily and quickly understand the nature of the changes proposed.  These plans will not form part of the final Bylaw.  The actual changes as they will be incorporated into the final Bylaw, and with the level of detail required for enforcement purposes, will be set out in the amended Schedules.

4.       Discussion

    Schedule 4: Special Parking Areas

4.1      Extension of Bus Stop at Main Road Stoke

           Following completion of the Greenmeadows Centre and subsequent upgrades to the Stoke Bus Stop, SBL raised concerns regarding parking which was installed south of the new bus stop. To ensure operational efficiency for the current bus service and to accommodate new longer buses, this carpark was removed, and the bus stop has now been extended approximately 5m south as shown in Attachment 1, titled 4.1.

4.2      Trafalgar Centre mobility carpark relocation

           Following the Trafalgar Centre upgrade and subsequent use of the facility, minor improvements have been proposed to the current mobility carparks situated along the main access road. It is proposed that one mobility park be relocated approximately 80m closer to the front entrance within the main Trafalgar Centre carpark as shown in Attachment 1, titled 4.2.

4.3      Buxton Square – Additional mobility carpark

Following feedback from users regarding mobility access to the Buxton Square toilet facilities, it is proposed that one additional mobility park be installed on the north-eastern entrance to the toilet. Two existing standard carparks will be removed as a result of installing one mobility park, along with a painted walkway to the nearby kerb drop down as shown in Attachment 1, titled 4.3.

4.4      Dodson Valley bus stop alterations

           As a result of safety concerns, officers altered the location of the existing bus stop, relocating it north of the recently upgraded Oldham Creek Bridge. The existing bus stop shall be deleted from Schedules, and replaced with the new bus stop location as reflected in Attachment 1, titled 4.4. This stop is primarily used for school buses and consultation included Clifton Terrace School, SBL Limited and affected residents who were supportive. 

Schedule 8: Time Limited Parking Areas

4.5      Marina Short Term Parking (P10)

Following requests from marina users, the need for short term parking has been identified opposite or near each of the marina pontoons. These short term (time limited) parks are to allow for users who simply drop off goods/materials to their yachts who would otherwise not be able to park in close proximity to each of the pontoons. It is proposed that one park near each of the marina pontoons be converted to P10 as shown in Attachment 1, titled 4.5. Feedback on proposed changes from the Marina User Group has been supportive.

4.6      235-241 Bridge Street (Removal of P15)

As a result of development between 235 and 241 Bridge Street, existing parallel car parks are being removed to become a vehicle entrance as shown in Attachment 1, titled 4.6, and subsequently the need for time limited parking no longer exists. The current P15 signs are therefore to be removed and deleted from the Bylaw Schedules.

Schedule 9: No stopping

4.7      Coster Street

Following signoff of the Coster Street Subdivision, roading infrastructure has now been vested with Council. These roads and subsequent markings need to be reflected in the bylaw and these changes are reflected in Attachment 1, titled 4.7.

4.8      Vickerman Street/Carkeek Street No Stopping

Following completion of Port Nelsons ‘Quay Connect’ along Vickerman Street, there is a need to alter the parking layout and install no stopping as shown in Attachment 1, titled 4.8. Businesses were consulted with and were supportive of the proposed changes.

4.9      Dodson Valley bus stop

Following upgrades to the Oldham Creek Bridge and prior safety concerns regarding the Dodson Valley bus stop, the bus stop has been shifted from its current location to improve safety and tie in with recent footpath upgrades. As a result, the current bus stop location has been deleted and replaced by no stopping as shown in Attachment 1, titled 4.4.

4.10    Village Lane (Montebello subdivision)

Following signoff of the Montebello Village Subdivision (Stage 3), roading infrastructure has now been vested with Council. These roads and subsequent markings need to be reflected in the Bylaw and these changes are reflected on the maps provided as shown in Attachment 1, titled 4.10.

Schedule 14: Give Way Signs

4.11    Rainbow Drive – New Give Way Sign

Following minor safety improvements in conjunction with the new Dodson Valley bus stop, a new give way sign has been added to the intersection of Rainbow Drive/Atawhai Crescent to improve safety. This sign shall now be reflected in the Bylaw Schedules and is shown in Attachment 1, titled 4.4.

5.       Options

5.1      There are limited alternative options for the items presented in this report as the majority in Schedules 4, 8, 9, and 14 are proposed changes to improve safe and efficient traffic movement. Option 1 is the preferred option.

·    Changes to Schedules are designed to improve safety and efficiency.

Risks and disadvantages

·    Nil

Option 2: Do not adopt changes as attached for Schedule 4, 8, 9 and 14

·    There are no identified advantages.

Risks and Disadvantages

·    Failure to approve changes could result in unsafe and inefficient use of the roading network.

The content and recommendation of this report is consistent with Council’s Community Outcomes – “Our infrastructure is efficient, cost effective and meets current and future needs”. In particular that we have good quality, affordable and effective infrastructure and transport networks. This report is directly aligned to the requirements of the Parking Policy, the Parking and Vehicle Control Bylaw and with Council’s strategic direction through the Regional Land Transport Strategy.

3.   Risk

To ensure that the Bylaw is enforceable, it is important to ensure that the Schedules are updated on a regular basis. Failure to update Schedules will open enforcement up to challenge. 

4.   Financial impact

Costs are within allocated annual budgets for road maintenance or capital projects.

5.   Degree of significance and level of engagement

This matter is of low significance. Sub-divisions, nearby businesses and residents that could be affected, have been consulted.

6.   Inclusion of Māori in the decision making process

No consultation with Māori has been undertaken.

7.   Delegations

The Hearings Panel - Other has the following specific delegations pertaining to the Parking and Vehicle Control Bylaw:

·      The power to make changes to the schedules to the Parking and Vehicle Control Bylaw that do not require public consultation

·         The power to hear submissions and recommendations on proposed changes to the schedules to the Parking and Vehicle Control Bylaw requiring public consultation.
