Referral of Powers - Request for Assistance from a Nelson sporting group

     

 

1.       Purpose of Report

1.1       To refer the mandate for decisions relating to a request for assistance from a Nelson sporting group to Council.

 

 

2.       Recommendation

That the Sports and Recreation Committee

Receives the report Referral of Powers - Request for Assistance from a Nelson sporting group (R9910); and

Refers to Council all powers of the Sports and Recreation Committee relating to a request for assistance from a Nelson sporting group.

3.       Discussion

3.1       A sporting group has written to Council seeking assistance. The delegation for considering this request would ordinarily lie with the Sports and Recreation Committee. However, the sporting group has characterised its request as urgent. Because the Committee will not meet until February 2019, it is proposed to consider the matter at the 13 December 2018 meeting of Council, in order to allow for a timely response to the group. 

3.2       Consideration of the request will be in public excluded session, in accordance with Section 7(2) (b) (ii) of the Local Government Official Information and Meetings Act 1987, to protect the group’s commercial position.

          Options

3.3       The Committee can either refer this matter to Council or not. Option 1 is recommended.

 

Option 1: Refer matter to Council

Advantages

·   Allows for a timely response

Risks and Disadvantages

·   Removes a decision from the Sports and Recreation Committee

·   More governance time required by full Council

Option 2: Do not refer matter to Council

Advantages

·    The Sports and Recreation Committee has delegated authority to consider matters relating to this matter

Risks and Disadvantages

·    Decision making on the issue will be slower due to the need to proceed through both Committee and Council

A decision to allow more timely decision making will support a local group providing services to the public.

 The recommendation to refer this matter to Council does not include any risks. If the Committee chooses not to refer the matter, there could be consequences for the Giants from a delay.

This decision has no financial impact.

5.   Degree of significance and level of engagement

This matter is of low significance as it is an administrative matter and not a substantive decision and therefore no consultation has been undertaken.

6.   Inclusion of Māori in the decision making process

No engagement with Māori has been undertaken in preparing this report.
