17.     Late Item: Arts Festival Governance Update         7 - 9

Document 5272

A report titled Arts Festival Governance Update is attached and to be considered as a major late item at this meeting.  This report was listed as item 17 on the public agenda for the Council meeting on 17 December 2015 to ensure elected members were aware that it would be presented to this meeting.

Section 46A(1)-(6) of the Local Government Official Information and Meetings Act 1987 and Standing Order 2.15.8 require that agendas are distributed with the associated reports.  As this report was not distributed with the agenda for this meeting, it must be treated as a major late item to be considered at this meeting.

In accordance with section 46A(7) of the Local Government Official Information and Meetings Act 1987 and Standing Order 3.7.5, a procedural resolution is required before a major item that is not on the agenda for the meeting may be dealt with.

In accordance with section 46A(7)(b)(i) the reason why the item was not on the agenda is because it came to hand after the agenda had been distributed.

In accordance with section 46A(7)(b)(ii) the reason why discussion of this item cannot be delayed until a subsequent meeting is because a resolution on the matter is required before the next scheduled meeting of the Council to enable a timely decision to be made.

 

 

 

Recommendation

THAT the item regarding Arts Festival Governance Update be considered at this meeting as a major item not on the agenda, pursuant to Section 46A(7)(a) of the Local Government Official Information and Meetings Act 1987, to enable a timely decision to be made.

REPORT R5216

Mayor's Report

     

 

1.       Purpose of Report

1.1       To update Council on various matters.

 

2.       Recommendation

THAT the Mayor’s Report Mayor's Report (R5216) and its attachments (A1437219) be received;

AND THAT the Central Business District Enhancement Panel draft Terms of Reference (A1437219) be received;

AND THAT $324 be paid from the Mayor’s Discretionary Fund for the Nelson Trolley Derby road closure application.

 

 

 

3.       Discussion

Central Business District Enhancement Panel

3.1       As noted in the Mayor’s Report of 19 November 2015, the Central Business District (CBD) Enhancement Panel has been established.

3.1.1    The terms of reference will be circulated to the Panel once they have been received by Council.  They are included as Attachment 1.

4.       Helping Nelson Trolley Derby Club

4.1       The Nelson Trolley Derby Club has applied for a temporary road closure for next year’s Collingwood Street trolley derby event. The Club has also applied for and been granted ongoing resource consent for the event, at a cost to the Club of $500.

4.2       Her Worship the Mayor has agreed to contribute $324 from the Mayor’s Discretionary Fund to cover the cost of the road closure application.

5.       Nelson Youth - Harry Denton

5.1       It is always heartening to see Nelsonians being successful on the world stage, and even in some of the more unusual pursuits.

5.2       Her Worship the Mayor would like to acknowledge the success of Harry Denton, who broke the world record for the longest “manual” or wheelie – covering a massive 334 metres balancing on his back wheel.

5.3       A big thank you to everyone involved in the attempt held at Nelson Airport and congratulations to Harry.

6.       Trafalgar Centre Advisory Group

6.1       Councillor Rainey has identified a need for a small advisory group consisting of Councillors and community representatives with events/marketing experience to help officers plan for and attract events in to the Trafalgar Centre in the year following its re-opening.

6.2       The group’s purpose is simply to provide suggestions and ideas to officers.  It will not be required to make decisions or report to Council or a committee.

6.3       If Councillors have suggestions for appropriate members of the group, please let Councillor Rainey know. He will convene the group in the New Year.

Arts Festival Governance Update

     

 

1.       Purpose of Report

1.1       To update Council on progress towards a new Governance Structure for the Art Festival.

2.       Delegations

2.1       This matter is for Council to decide as it spans more than one committee (Governance and Community Services).

 

3.       Recommendation

THAT the report Arts Festival Governance Update (R5272) be received;

AND THAT officers bring terms of reference for a Arts Festival Transition Group to the Council meeting on 18 February 2016.

 

 

 

4.       Background

4.1       During its deliberations on the Long Term Plan, Council resolved:

THAT an independent governance structure be established for the Nelson Arts Festival with transfer of operations to occur in time for the new entity to be responsible for the 2017 Arts Festival;

AND THAT Council express its preference for the Arts Festival to remain an annual event;

AND THAT the Masked Parade and Readers and Writers Week be transferred with the Nelson Arts Festival to the independent governance structure;

AND THAT the allocation in the draft 10 year budget for the Nelson Arts Festival, Masked Parade and Readers and Writers week be confirmed at current levels;

AND THAT an allocation of $15,000 be made for the expense of establishing the governance structure, including meeting all Local Government Act requirements.

4.2       Officers have been working on a report bringing options to this Council meeting. However, as the options have been worked through several significant questions have arisen in relation to; the strategic objectives of the transition; the logistics of the transition (e.g. which responsibilities would transfer and which would stay in house); and how any risks associated with the transition might best be mitigated.

5.       Discussion

5.1       Whilst there is a strong desire to establish a new governance structure for the arts festival, there is no time pressure to do so at present and officers recommend that taking additional time to build the strategic picture around the transition is worthwhile.

5.2       Officers have noted the value in the approach taken to the economic development services review and suggest that the establishment of an Arts Festival Transition Group comprising of people with relevant expertise from the community would add value to the establishment process. This would also allow Council to gauge the level of community interest for participation at the strategic/governance level.

6.       Options

6.1       Council could decide to workshop this issue further. This would allow discussion around some of the strategic issues that have been identified. However, Councillors have discussed this matter on a number of occasions previously and it is not thought that this would be good use of valuable workshop time.

6.2       Council could ask officers to present the report as has been drafted. However this would still not be able to cover off the strategic issues identified, and Council may not have enough information to make a decision.

6.3       The preferred option is for Council to convene a working group, and to  appoint individuals in our community to consider the issues and risks and opportunities, and for that group to make recommendations to Council on these matters.

6.4       If this option is approved, officers will bring Terms of Reference to the next Council meeting (February 18, 2016) and will identify possible members for the working group.

7.       Alignment with relevant Council policy

7.1       This recommendation is consistent with previous Council resolutions and with Council policy.

8.       Assessment of Significance against the Council’s Significance and Engagement Policy

8.1       This is not a significant decision in terms of Council’s Significance and Engagement Policy.

9.       Consultation

9.1       Council has consulted on changing the governance structure of the arts festival through the Long Term Plan. The recommendation would allow for further consultation with interested parties.

10.     Inclusion of Māori in the decision making process

10.1     Maori have not been specifically consulted in making the report recommendations.
