7. Late Item: Chairperson's Report 3 - 4

A report titled Chairperson's Report is attached and to be considered as a major late item at this meeting. This report was listed as item 7 on the public agenda for the Community Services Committee meeting on 24 September 2015 to ensure elected members were aware that it would be presented to this meeting.
Section 46A(1)-(6) of the Local Government Official Information and Meetings Act 1987 and Standing Order 2.15.8 require that agendas are distributed with the associated reports. As this report was not distributed with the agenda for this meeting, it must be treated as a major late item to be considered at this meeting.
In accordance with section 46A(7) of the Local Government Official Information and Meetings Act 1987 and Standing Order 3.7.5, a procedural resolution is required before a major item that is not on the agenda for the meeting may be dealt with.
In accordance with section 46A(7)(b)(i) the reason why the item was not on the agenda is because it came to hand after the agenda had been distributed.
In accordance with section 46A(7)(b)(ii) the reason why discussion of this item cannot be delayed until a subsequent meeting is because a resolution on the matter is required before the next scheduled meeting of the Community Services Committee to enable a timely decision to be made.
Recommendation
THAT the item regarding Chairperson's Report be considered at this meeting as a major item not on the agenda, pursuant to Section 46A(7)(a) of the Local Government Official Information and Meetings Act 1987, to enable a timely decision to be made.

Chairperson's Report
1. Purpose of Report
1.1 To consider amending the age group details within the Outline Business Case for Rutherford Playground project 2294.

Rutherford Playground
3.1 I have followed a request from the Deputy Chair of this committee, Councillor Noonan, to allow you all to give further consideration to the wording defining the proposed Rutherford Park playground. I have taken the step as the infrastructure team are at the point where they are about to go out to tender for work on concept designs for the playground. A set of designs will be produced that will inform all councillors at a workshop scheduled for 1 December. At this workshop a set of design options will be presented with a range of prices. These design options may trigger discussions on financial partnerships.
3.2 There is concern that the wording ‘five to thirteen year olds’ set out in the outline business case received at the Community Services Committee meeting of 13 August 2015 is too narrow.
3.3 The resolution at the 13 August 2015 meeting said:
THAT the report Outline Business Cases for Selected 2015/16 Projects (R4357) and its attachments (A1306172 and A1328462) be received and that the risks therein be noted.
3.4 Within attachment two of this report (A1328462) under Option 2 it describes that a playground will be created which is capable of attracting and actively engaging primarily the 5yr to 13yr age group for at least 1½ hours.
3.5 I am happy to give the committee a further opportunity today to give consideration that the project be advanced by the infrastructure team allowing for a broader definition to inform the concept designs. The reason this has come as a late item today is that if we don't attend to this now, a delay of six weeks would occur as the next opportunity to do so would be at our next meeting.
3.6 In order for this broadening to occur, a further resolution is required.
3.7 To that end, this report seeks to amend Option 2 of the Outline Business Case for Rutherford Playground project 2294 to read:
“Creating a playground which is capable of attracting and actively engaging a wide age group primarily focussed on the 5-13 years age group.”
3.8 As mentioned, a workshop to discuss concept designs for the playground is expected to be held on 1 December 2015.
